The Brokerage AI Policy Prompt

If your agents use AI, the brokerage needs a rule they can read in two minutes.

By Casey McClintic, founder. Updated 10/28/2026.

This prompt asks about your office, sorts what may and may not go into an AI tool, sets who reviews before anything publishes, adds a fair housing line and a disclosure rule, and hands back a one page AI and client data policy with the open decisions marked. It is not legal advice, and your attorney reads the final page.

How it works

Three steps.

  1. Copy the prompt into ChatGPT, Claude or Gemini, or open one with a click.
  2. Answer about your office: who uses AI today, which tools, what client information you handle, and who reviews work before it goes out.
  3. Approve the one page, settle every line marked to decide, and have your attorney or compliance officer read it before you share it with the agents.

Run it

ChatGPT and Claude open with the prompt pasted. Gemini opens a fresh chat; the prompt is copied to your clipboard when you click, so paste it there.

What happens in the chat

  1. Phase 1: the office. How many agents, who uses AI and for what, which tools are in use, who owns technology and compliance.
  2. Phase 2: the data line. You sort client names, offer terms, financial information, photos and unlisted properties into never, approved tool only, or fine anywhere.
  3. Phase 3: review and fair housing. Who reads every draft before it goes out, what they check, and a fair housing line that travels with every draft.
  4. Phase 4: disclosure and fake activity. When you tell a client that AI helped, and a not allowed list: fake accounts, fake reviews, fake engagement.
  5. Phase 5: the page. Under 350 words in a fixed format, every open question marked to decide, and a review date.

What you end up with

  • A one page AI and client data policy in a fixed format
  • A sorted list of what never goes into an AI tool
  • Every open decision marked to decide
  • A date to review the policy again

FAQ

Questions, answered

Is this legal advice?

No. It is a drafting partner. The page it hands back is a starting point for the rules your brokerage writes for itself, and it is built to leave any question it cannot answer marked to decide. Your attorney or compliance officer should read the final page, and can tell you what your state, your MLS and your franchise require.

Which AI tool should I run it in?

Any assistant you already use. If you have not picked one yet, the answer page on which AI a brokerage should use covers what to check first. Whatever you run it in, do not paste client names, contact details or contract terms into the chat. The prompt does not need them.

How often should the policy be updated?

Put a review date on the page itself and keep it. AI tools and their terms change often, so a yearly read at the very least, and again any time the office switches tools. Run the prompt again with the old page pasted in and ask what changed.
