Yes. Agents are already using AI, and one page settles four things before they come up: what client data goes in, who reviews before anything publishes, how fair housing is protected, and when you tell people AI helped. It takes an afternoon to write.

The short version
Yes, and it can be one page. In NAR's 2026 REALTORS Technology Report, 23% of agents use AI daily and 25% weekly. Among agents who use AI, 91% use ChatGPT, 42% Gemini, 27% Copilot, 25% Claude and 14% Apple Intelligence. Those add up to well over 100%, so agents are using more than one tool. Without a rule, each agent decides alone what to paste into which tool.
Almost nobody has one
Metricool's 2026 State of AI in Social Media Study, based on responses from more than 700 social media professionals, found only 12% have a clearly defined AI policy, and 35% report having no restrictions or formal rules around how they use AI at work. Those are social media professionals, not brokerages, but the pattern is a useful warning.
Client data
In a survey Anthropic ran with small business owners, half named data security as their single biggest hesitation about AI, and Anthropic says it does not train on data by default on its Team and Enterprise plans. The plan matters, so the policy names the approved tool and plan, says what never goes in, and says who read the plan's data terms.
Review before publishing
Google's Search Central guidance says it is critical to manually fact-check and review all AI-generated content before publishing, including titles, meta descriptions, structured data and image alt text (last updated October 1, 2026). The policy sets the same rule for everything: a named person reads every AI draft before it goes out. Metricool's 2026 study also found 14% of social media professionals say AI-generated content performs worse than non-AI content, nearly three times the 5% reported in 2025.
Fair housing and disclosure
Fair housing belongs in the policy in plain words: describe the home and what clients are doing, never who lives somewhere or who a home is for. AI drafts can wander into that territory, so review is where it gets caught. For disclosure, Anthropic's Usage Policy requires a qualified human in the loop, and telling the affected person that AI was used, when its products are used in ways that can affect someone's health, legal rights, finances, livelihood or access to essential services (2026 Usage Policy update, October 8, 2026). A brokerage can set a plainer rule of its own: tell people when AI wrote or analyzed something they will rely on. The same update, effective November 12, adds a section on deceptive campaigns and artificial activity, covering efforts to obscure who is behind a message or amplify content through fake accounts or posts. Put the same ban in yours.

FAQ
This page is not legal advice. A policy is a set of rules the brokerage writes for itself. Ask your attorney or compliance officer what your state, your MLS and your franchise require.
One page. A policy agents can read in two minutes does more than a long one nobody opens.
Set a plain rule of your own and have counsel check it. A good default is to tell people when AI wrote or analyzed something they will rely on.
Name the approved assistant and say why. Give agents a way to ask for another one. A rule that matches what people really do is the one that gets followed.
